CASE STUDY #8
Assessment of New Chinese Division of an International Energy Company
The client required experts to assess a newly established division’s compliance with company policy.
UHY Advisors was tapped to visit the new China division and conduct the assessment. The UHY Advisors team discovered that essentially all items imported into the country were facilitated through a local agent. UHY Advisors determined the company was at high risk because there was no contract with this agent who had significant interactions with governmental officials.
As a result of the UHY Advisors special project, general counsel worked with the division and negotiated a contract with the agent. The contract included numerous provisions to help demonstrate the company’s commitment to comply with the FCPA and to reduce the company’s exposure to violations.
